General Conditions of Sale, shipment and return


Preamble

These General Conditions of Sale apply exclusively to TAG Heuer SA (hereinafter ‘Us’) and any person visiting or purchasing through the Website www.tagheuer-timing.com (hereinafter ‘You’). 

All Internet users should be aware of the general conditions of sale on the  shop.tagheuer-timing.com website (hereinafter the ‘Website’).
In consequence, the placing of an order implies the purchaser’s full and unreserved acceptance of these General Conditions of Sale, to the exclusion of any other document such as prospectuses or catalogues issued by the seller which only carry an indicative value. If the seller should refrain at any given moment from making use of any one of the conditions of these General Conditions of Sale, this should not be interpreted as a waiver of the right to use any of the said conditions in the future.
Our offers are reserved exclusively for end-customers, excluding professional distributors.
These General Conditions of Sale may be subject to modifications; applicable conditions are those in force on the Website on the date that the order is placed. 

Contract

After confirming your order, we will send you an e-mail with your order details. This email constitutes the original receipt of sale.

We will inform you by e-mail when your order has been dispatched. This e-mail constitutes the acceptance of your order and thus forms the contract of sale between You and Us. 

Price 

Prices displayed on the Website exclude VAT (except for Switzerland and Liechtenstein) – subject to the conditions below -, and are in CHF,
Dispatching and processing costs of your order are in CHF .
Any prices shown in different currencies are converted into CHF.
The maximum order quantity is set at 3 units per customer.  

Customs Duties

All orders made through the Website and delivered outside Switzerland may be subject to taxes and customs duties when the parcel arrives at its destination. These customs duties and taxes related to the delivery of an item are at your expense and are your responsibility. We are under no obligation to check and inform you of applicable customs duties and taxes. To find out about these charges, we advise you to ask the competent authorities in your country. 

Placing an order

An order is placed using a step-by-step process. When you click on ‘Confirm’ in the last step, we send your information to a secured payment system which checks your credit card details. Your order will not be dispatched and your credit card will not be debited if you do not click on ‘Confirm’. 

Payment

Your order can only be paid for by credit card.

TAG Heuer Timing accepts the following credit cards:

Reservation of Ownership

TAG HEUER SA remains the proprietor of items sold until full and effective payment of the entire purchase price has been received. Full payment incites transfer of ownership; the purchaser becomes responsible for items from the moment of delivery and the transfer of ownership leads to the transfer of risks. 

Transport and Liability

Merchandise travels at your expense, risk and peril. It is therefore your responsibility to check the content of a parcel upon delivery and to file a claim where applicable in the following manner: use the delivery slip provided by the courier and, in all cases, informs TAG Heuer SA using the contact form available on our Website within three (3) days of parcel delivery.  

Handling and dispatching

Your order is dispatched as soon as possible, in principle one working day after your order is placed. Delivery times are imposed by our logistics service provider SwissPost (http://www.swisspost.ch/). In no event are we able to guarantee these delivery times.

If items are unavailable despite our best efforts, you will be informed by e-mail as soon as possible. Your order will be cancelled and the total amount paid for the item will be refunded.

Handling and dispatching costs are based on standard packing and postal services carried out by SwissPost.

Standard dispatching (Switzerland and Liechtenstein)

In principle, orders for Switzerland and Liechtenstein are delivered within 4 - 5 working days (Monday to Friday, except public holidays) after placement of the order.  

Standard dispatching (International)
Austria, Belgium, Germany, Great Britain and Northern Ireland (except Jersey, Guernsey and the Isle of Man), Italy, Luxemburg, Monaco, the Netherlands, San Marino and Vatican:
In principle, orders are delivered within 6 - 12 working days (Monday to Friday, except public holidays) after placement of the order.

Albania, Andorra, Belarus, Bulgaria, Bosnia-Herzegovina, Cyprus, Croatia, Denmark, Spain, Estonia, Faroe Islands, Finland, Gibraltar, Greece, Greenland, Hungary, Ireland, Jersey, Jersey/Guernsey, Iceland, Kosovo, Latvia, Lithuania, Macedonia, Malta, Isle of Man, Moldova, Norway, Poland, Portugal and the Azores and Madeira, Romania, Russia (Federation), Serbia and Montenegro, Slovakia (Slovak Republic), Slovenia, Sweden, Czech Republic, Turkey and the Ukraine:
In principle, orders are delivered within 7 - 17 working days (Monday to Friday, except public holidays) after placement of the order.

Algeria, Egypt, Israel, Jordan, Lebanon, Libya, Morocco, Mexico, St. Pierre and Miquelon, Syria, and Tunisia:
In principle, orders are delivered within 9 - 22 working days (Monday to Friday, except public holidays) after placement of the order.

In principle, orders are delivered within 17 - 27 working days (Monday to Friday, excluding holidays), after placement of the order.

Returns and exchanges with the original sales receipt

TAG Heuer SA holds its customers in high esteem, and we therefore wish to guarantee you complete satisfaction.

You have a seven (7)-day right of retraction, which is applicable upon the delivery of your order. Items should be returned to us according to the following conditions for exchange or refund: in as-new condition, with the original receipt and if possible in their original packaging. You are not required to provide a reason.

In the event that you receive an item that does not correspond to your order or that has been damaged during transportation, please inform us using the contact form on our Website.

If we accept to replace a damaged product or a product that does not correspond to your order, the product should be returned to us within the 7 days following the date on which you confirmed its replacement with us. We will replace the item immediately upon receipt. In the event of non-compliance with your obligation to return the damaged or unexpected product within the aforementioned 7-day deadline, replacement of the product will be refused.

TAG Heuer SA will only bear the cost of returns (at the basic tariff in use) if one of the following two conditions applies: the item delivered does not correspond to the order, or you have filed a claim with the courier (see Transport and Responsibility article above).  

Product returns or exchanges

To return or exchange a purchase made on our Website:
1. Contact us using the contact form on our Website
2. Print the original receipt (order confirmation e-mail)
3. Pack and insure the item to be returned, in its original packaging if possible, and include the original receipt. Packages must be returned with postage costs paid; no deliveries with payment-upon-receipt will be accepted.

Guarantees and Responsibility

We decline all responsibility in the event where an item delivered does not comply with the legislation in force in the country of delivery, with the exception of Swiss legislation.

We are committed to providing all usual care and attention to the standards demanded by our profession in the service we offer to our customers. However, we cannot be held liable for failure to fulfil contractual obligations through unforeseeable circumstances or events of force majeure as defined by Swiss jurisdiction.

We will not be held liable in the event of insubstantial differences between item photos, texts and illustrations on our Website, and the items delivered.

We do everything in our power to provide the services mentioned in these General Conditions of Sale.  

Applicable legislation and competent jurisdiction

In the event of difficulties in the application of these General Conditions of Sale, we invite you to seek an amicable solution by contacting our TAG Heuer Timing department.

If negotiations are unsuccessful, the following clause will be applied:

This contract is subject to Swiss legislation. Any dispute arising from the execution or interpretation of this contract will be brought before the Geneva jurisdiction.
